Burlington Stores, Inc., and its affiliates and subsidiaries (“Burlington”), respects your privacy and values your trust. This is why we are committed to protecting your privacy and using the information you share with us responsibly to better serve you. This Privacy Policy describes how Burlington and some of its third-party service providers collect, use, disclose and safeguard the personal information you provide on our website, www.burlington.com (the “Site”), as well as information collected when you visit our stores, through interest-based online advertising, or otherwise communicate or interact with us. This Privacy Policy does not apply to information provided directly to our banking partner, which offers the Burlington credit card. As used in this Privacy Policy, “Personal Information” means information that identifies or can reasonably be linked to a specific individual, such as name, address, e-mail address, phone number, driver’s license number, or credit card number.

Our Site is intended for users located exclusively in the United States of America. The information practices and the terms of this Privacy Policy may or may not comply with foreign law. By using our Site, you consent to the use and disclosure of your information in accordance with this Privacy Policy and subject to the applicable state and federal laws of the United States.


 

INFORMATION COLLECTED

Burlington and its third party service providers collect Information about you from a variety of sources, including Personal Information you provide directly to us, and information we collect about you when you access and use our Site or shop in our stores. We may combine any of the Information collected about you for the purposes described in this Privacy Policy.

  • Identifying information: We may collect your personal Information such as your name, online identifier, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), mailing addresses, email address(es), phone numbers, internet protocol address, email address, account name, Social Security number, driver’s license number, passport number, and other similar identifiers;
  • Social Media: When you interact with, or if you are a fan/follower of, Burlington on social media, we may receive information such as your user ID, handle, your profile picture, photos you post, and other profile elements, including any comments, with us. Note that your use of social media is are subject to the terms and conditions and privacy policies of each respective social media platform, and the information you share with us and with others is largely controlled by the privacy settings you have established at those platforms.
  • Information you submit: we may collect preference information, or survey answers/opinions, which you submit to us in connection with various marketing and promotional activities, surveys or contests conducted in our stores;
  • Demographic Information: we may collect your education level, income level, birthdate, gender, marital status, number of children and their ages, and zip code.
  • Payment information: we may collect your signature, bank account number, credit card number, debit card number, billing address and other financial information.
  • Geolocation: we may collect precise location information from your device.
  • Commercial Information: we may collect information about the products you purchased or considered purchasing from us, as well as your other purchasing or consuming histories or tendencies.
  • Online and Internet Activity: We may also collect your Internet and other electronic network activity information, including, but not limited to, your internet service provider's address, information about the browser you are using when visiting our Site or we may look at what Site you came from, or what Site you visit when you leave ours, other browsing history, , information regarding your interaction with websites, applications or advertisements, and the language and time zone settings on your web browser;
  • Sensory information: If you visit our stores, we may capture audio, electronic, visual, thermal or similar information with our surveillance equipment.

 

HOW WE COLLECT INFORMATION

Burlington collects information in different ways:

Directly:

  • When you make a purchase on our Site or in our stores,
  • When you purchase a service, such as Layaway.
  • When you return or exchange a product you purchased,
  • We you purchase and/or receive a Burlington electronic gift card,
  • By signing up to receive promotional emails,
  • When signing up to receive an electronic receipt for your store purchase,
  • By joining our Burlington Loyalty program,
  • By entering in one of our promotional sweepstakes, contests, responding to surveys or participating in a focus group or customer panel,
  • If you contact our Customer Service center,
  • When interacting with Burlington in social media,
  • By applying for a job,

  • When you visit our Site,
  • When visiting our stores we may capture audio, electronic, visual, thermal or similar information with our anti-theft surveillance equipment,
  • By location-based features when using your device to access our Site,
  • By clicking on a Burlington ad on a third-party property,
  • Use the Wi-Fi Services provided in some of our stores,
  • When interacting with pixels and cookies on our Site.

Automatically:

  • Cookies: Cookies are small text files stored by your browser that allow us to learn more information about your visit or use of our Site. We may use cookies to remember your Personal Information to track your usage of our Site over time. Most browsers automatically accept cookies. You have the choice to set your browser to accept or reject cookies. Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences.
  • Analytics Information: We may use third-party analytics tools, such as Google Analytics, to help us measure traffic and usage trends for our Online Services. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving our Site and providing you a more personalized experience.
  • Device and Browsing Information: We collect certain information about your computer or device each time you access our Site.  Servers may automatically record certain log file information such as your web request, Internet Protocol (IP) address, MAC address, physical location data, browser type, referring / exit pages and URLs, number of clicks and how you interact with Linked Sites, domain names, landing pages, pages viewed, and other such information.
  • Clear Gifs/Web Beacons: When you use our Site we may employ clear gifs (also known as web beacons) which are used to track your online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information facilitates more accurate reporting and improvement of our Site.
  • Location Data: When you access our Site via a mobile device, we may access, collect, monitor, and/or remotely store information regarding your mobile device, as well as real-time “location data,” which may include GPS coordinates. Location data may convey to us information about how you browse and use our Site. You may opt-out from allowing us to have access to your location data by adjusting the permissions in your mobile device, though some features of our Site may not function properly if use or availability of location data is impaired or disabled.
  • Information We Receive From Third Parties: We may receive Information about you from third parties. For example, if you access our Site through a third-party connection or log-in (e.g., through Facebook), such third party may pass certain information about your use of its service to us. Combined Information:

  • Information you provide at our retail stores may be combined with information that you provide online at the Site, as well as with information about your interests and purchases we collect automatically. The information you provide to us may also be combined with demographic and other information that is available from other sources in order to allow us to better communicate with you and enhance our customer service and your shopping experience.

  • We collect information from other sources, through or in connection with apps or software sponsored by Burlington, or on other websites hosted or sponsored by us. We may combine or cross reference this information with other information that we collect about you to help us improve the quality of your experience with Burlington and tailor communications to your interests.
  • We may collect information about you from social media platforms, such as Facebook, Twitter and Instagram, and from our business partners, including online advertising networks and companies that co-sponsor our promotions

 

HOW WE USE THE INFORMATION WE COLLECT

Burlington may use information about you for the purposes described in this Policy or otherwise disclosed to you, including:

SHARING OF INFORMATION

Burlington shares information about our customers with affiliated companies, vendors, business partners and service providers. These companies need information about you, including your name, address, phone number, email address, to perform their service function (such as to process your payment and fulfill your order, verify your credit card information, and to protect you  and us from fraud). We may also share your information with third parties such as those that provide financial products and services related to our business and those that co-sponsors our contests, events or other promotions.  We also share your information, including your name, address, phone number, email address, and shopping preferences, with specially chosen companies that help us with marketing functions (such as manage our Internet business, maintain and manage our customer information, as well as market our products and services). We may display information you choose to post on our Ratings & Reviews feature.  At times we may share information with other companies that have a product or service that we believe will be of interest to you and/or may help them serve you better. We may engage vendors to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may collect certain information from you (e.g. click stream information, browser type, time and date, hardware/software information, cookie ID, IP address, etc.) when you visit our website and use that information to provide advertisements about goods and services that are deemed to be of greater interest to you. These third parties may also share your information with others. These third parties may use your information for their own marketing purposes or the marketing purposes of others. Burlington is not responsible and has no liability for the privacy policies or practices of Linked Sites. We recommend that you review the privacy policies of each Linked Site you visit.


 

GOOGLE ANALYTICS

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on certain of our Online Services. Google Analytics uses cookies to collect information such as how often you visit our Site, what pages you visit within our Site, and what other sites you visited prior to coming to our Site. We use the information provided by Google Analytics to improve our Site and services. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our Site. By using our Site, you consent to the processing of data about you by Google as specified herein. JOB POSTINGS

This Site may include job postings from time to time for Burlington job opportunities at its store locations, distribution centers, and corporate offices.  Should you wish to do so, you may apply for such job openings online through an applicant tracking system operated by iCIMS by creating an applicant profile and submitting an application via the Site, which information is usually received by Burlington’s human resources department. Once submitted, your application, resume or CV (if applicable), and other personal information (collectively, “Applicant Information”) may also be made available to additional human resources personnel and/or hiring manager(s) at the Burlington location to which you are applying. In addition, your Applicant Information will be stored in that tracking system in an electronic database maintained by iCIMS on behalf of Burlington.

All such Applicant Information may be used by Burlington for the purpose of assessing your suitability for current and future job opportunities and to assist with Burlington’s recruitment and application processes.

As discussed above, as part of the application process, you will be required to create an applicant profile with a user name and password.  You are solely responsible for maintaining the confidentiality of that username and password, and for any unauthorized access or use of your user name and password.


 

HOW TO UPDATE YOUR PERSONAL INFORMATION

You may review, update, correct or delete your online account information at any time by contacting us to request changes to any of your information. We will respond to your request consistent with applicable law. Customers who no longer wish to receive our promotional materials may opt-out of receiving these communications by clicking the unsubscribe link at the bottom of the email or contacting customer service. If you want to update information in the iCIMS tracking system, please contact iCIMS as noted in their privacy policy. In some cases, we may need to retain and use personal information obtained previously to verify your identity and as otherwise required or permitted by applicable law.

When required in your jurisdiction, Burlington will permit individuals to access, correct, amend or delete Personal Information that is demonstrated to be inaccurate or incomplete. If you request access, correction, amendment or deletion of your Personal Information and you have more than one account with us, you will need to instruct us on each account separately. In certain jurisdictions, you may make a request for information by completing this form.


 

CHILDREN’S PRIVACY

This Site is not designed or intended to be used by anyone under the age of 18. If you are under the age of 18 (or a minor in the jurisdiction in which you are accessing our Sites), do not use the Site, or make purchases via the Site, use any interactive features of the Site, or post any Personal Information to our Site. We do not knowingly or intentionally gather Personal information about children who are under the age of 16. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 16, please contact us at privacy@burlington.com. If we learn that we have inadvertently collected the Personal Information of a child under 16, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible and cease the use of that information in accordance with applicable law.


 
 

COOKIES POLICY

“Cookies” are small text files that are transferred from websites to your computer’s hard drive that may serve a variety of purposes (web beacons, Flash cookies and other similar technologies may also be used for these purposes). When you use our website, we, like many other websites, place a cookie on your computer to identify you to provide a more convenient shopping experience and to place advertisements for our products and services and those of third parties on our website and third-party sites. This California Consumer Privacy Statement supplements Burlington Stores, Inc.’s Privacy Policy and applies solely to consumers who are California residents.  This Statement does not apply to our associates, job applicants and vendor personnel.

This California Consumer Privacy Statement uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 (the “CCPA”).

c. Sale of Personal Information

We do not sell your personal information in exchange for monetary compensation. We may allow certain third parties (such as certain advertising partners) to collect your personal information via automated technologies on our website in exchange for non-monetary consideration such as an enhanced ability to serve you content and advertisements that may be of interest to you. You have the right to opt out of this disclosure of your information, as detailed below.

During the 12-month period prior to the effective date of this California Consumer Privacy Statement, we may have sold the following categories of personal information in connection with advertising only:

  • Identifiers such as a real name, alias, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), online identifier, internet protocol address, email address, account name, and other similar identifiers

We do not sell the personal information of minors under 16 years of age without affirmative authorization if we have actual knowledge of the individual’s age.


d. Disclosure of Personal Information for a Business Purpose

We disclosed to third parties the following categories of personal information for a business purpose:

  • Signature, physical characteristics or description, state identification card number, insurance policy number, education, bank account number, credit card number, and other financial information, medical information, and health insurance information
  • Characteristics of protected classifications under California or federal law, such as race, color, national origin, religion, age, sex, gender, gender identity, gender expression, sexual orientation, marital status, medical condition, ancestry, genetic information, disability, citizenship status, and military and veteran status
  • Commercial information, including records of products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies
  • Biometric Information
  • Internet and other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with websites, applications or advertisements
  • Geolocation Data
  • Audio, electronic, visual, thermal, olfactory, and similar information

  • Education information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99)
  • Inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

 

Exercising your California Consumer Privacy Rights

If you are a California consumer, you have the following rights. We will honor requests received to the extent required by applicable law and within the time provided by law.

Access:

You have the right to request, up to twice in a 12-month period, that we disclose to you the categories and specific pieces of Personal Information we have collected about you. Specifically, you have the right to request that we disclose the following to you, in each case in the twelve-month period preceding your request:

  • the categories of Personal Information we have collected about you;
  • the categories of sources from which the Personal Information is collected;
  • our business or commercial purpose for collecting or selling Personal Information;
  • the categories of third parties with whom we share Personal Information;
  • the specific pieces of information we have collected about you;
  • the categories of Personal Information about you, if any, that we have disclosed for monetary or other valuable consideration and the categories of third parties to which we have disclosed the information, by category or categories of Personal Information for each third party to which we disclosed the Personal Information; and
  • the categories of Personal Information about you that we disclosed for a business purpose.
  • Deletion: You have the right to request that we delete personal information we have collected from you.
  • Opt-Out of Sale: You have the right to opt-out of the sale of your personal information.  We do not generally sell information as the term “sell” is traditionally understood. However, if and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for interest-based advertising, we will comply with applicable law as to such activity.

Some of our third party partners may collect and share certain pieces of information from our visitors, such as device identifiers, cookies, advertising IDs, IP addresses and usage activity, so that our third party partners can deliver ads to you and conduct analysis about our services.   • The opt-outs described in this section are device and browser based.  You must opt out on each device and each browser where you want your choice to apply.
  • Opt-outs may be stored via cookies. If you clear cookies, your opt-out will no longer be valid and you must opt out again where you want your choices to apply.
  • Burlington does not maintain or control the opt-out mechanisms and settings described in this section and is not responsible for their operation.
  • Exercising these choices does not prevent us from delivering contextual advertising, advertising to you based on data we have about you, conducting cross-device tracking for us to serve you first-party ads directly, or using information for non-targeted advertising purposes, such as attribution and analytics. 
  • We may also still share some personal information with our partners (who will function as our service providers in such instance) to help us perform functions such as measuring ad effectiveness, controlling how many times you see an ad, ad delivery, providing aggregate statistics and analytics, and/or reducing ad fraud.
  • The choices described in this section may not opt you out of the use of previously collected and shared information or all interest-based advertising (such as that conducted on other sites). NON-DISCRIMINATION

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
